These Terms of Use govern access to Ninelume, published by Earthquake Games, a brand of Earthquake Digital Serviços de Audiovisual LTDA, CNPJ 35.367.701/0001-48. By installing, accessing, or using the game, you confirm that you have read and agree to these terms. If you do not agree, do not install or use Ninelume.
Ninelume offers a solo Sudoku experience, including local game features and, where made available, a puzzle catalogue, progress sync, and game verification. The game is designed to work without a network for its essential solo functions; features that depend on a server may require a connection and may be temporarily unavailable.
You must use Ninelume in accordance with applicable law. If you are not old enough to accept these terms in your jurisdiction, ask a legal guardian to read and accept them on your behalf where required.
The product may create a pseudonymous guest account for sync. This account is not a civil identity and depends on the credentials protected on your device. You are responsible for keeping your device and credentials under your control. We do not guarantee recovery of progress if you remove the app, lose the device, or delete the account without a recoverable sync.
Subject to these terms and the rules of the applicable store, Ninelume grants you a personal, limited, revocable, non-exclusive, non-transferable, and non-sublicensable licence to install and use the app on devices you control, exclusively for personal, non-commercial use.
This licence does not transfer ownership of the game, the catalogue, the brand, the design, the code, the texts, or any other Ninelume materials. All rights not expressly granted remain reserved.
Except where expressly permitted by law, you may not:
We may limit or suspend network features when there is a reasonable indication of a breach of these terms, a security risk, or a legal requirement. Wherever technically possible, this measure will not affect local access to your game.
Ninelume, its puzzles, visual identity, texts, trademarks, software, and other materials are protected by applicable law and belong to Ninelume or its licensors. Do not use these materials outside the licence above without prior written authorisation.
If you send suggestions or feedback, we may use them to improve the product without any obligation to compensate you, subject to rights that applicable law does not allow you to waive.
When you obtain Ninelume through an app store, that store's terms also apply. The store is responsible for the distribution transaction it processes; Ninelume does not control the availability, support, or operational rules of the App Store, Google Play, or the operating system. In the event of a conflict, the mandatory rules of the store and of applicable law prevail to the extent required.
We may release updates to fix problems, strengthen security, or improve the game. Some updates may be necessary to keep online features compatible. We aim to keep the service available, but we do not guarantee uninterrupted, error-free operation or compatibility with every device and system version.
We may also change, add, suspend, or discontinue non-essential features, respecting rights already guaranteed by applicable law and, where necessary, giving you adequate notice. Offline solo play is a product principle, not a promise of eternal compatibility with discontinued hardware or systems.
To the maximum extent permitted by law, Ninelume is provided "as is" and "as available". We do not promise that the game will suit every specific purpose, that content will always be available, or that sync will prevent all data loss. Sync when available and keep your device protected.
Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including non-waivable consumer rights. Where the law permits, we will not be liable for indirect, incidental, special, or consequential damages, or for loss of data arising from the use of, or inability to use, Ninelume.
The processing of personal data is described in the Privacy Policy. By using sync features, you acknowledge that they require the limited processing of pseudonymous and game data described in that policy.
We may change these terms to reflect changes in the product, the law, or the way the service operates. The current version will be published on this page with a revised update date. For significant changes, we will provide the additional notice required by applicable law. Continued use after an update takes effect constitutes acceptance, where that form of acceptance is valid under applicable law.
These terms are interpreted in accordance with the law applicable to the consumer relationship and the services offered. Nothing in them limits mandatory rights, including the choice of venue or dispute resolution mechanisms guaranteed to consumers by the law of their place of residence.
